{"id":504225,"date":"2020-11-06T11:41:49","date_gmt":"2020-11-06T17:41:49","guid":{"rendered":"https:\/\/www.helplinecenter.org\/?page_id=504225"},"modified":"2021-07-01T08:38:52","modified_gmt":"2021-07-01T13:38:52","slug":"south-dakota-marijuana-laws-qas","status":"publish","type":"page","link":"https:\/\/hlc.thinkcaliber.com\/es\/2-1-1-community-resources\/helpsheets\/south-dakota-marijuana-laws-qas\/","title":{"rendered":"South Dakota Marijuana Laws Q&#038;A\u2019s"},"content":{"rendered":"<p>South Dakotans approved two ballot measures that will change marijuana laws across the state when they went to the polls on November 3, 2020.&nbsp;&nbsp;<\/p><p><strong>South Dakota Department of Health<\/strong> has a website with up to date information: <a href=\"https:\/\/medcannabis.sd.gov\/\" target=\"_blank\" rel=\"noopener\">https:\/\/medcannabis.sd.gov\/<\/a><\/p><ul><li><a href=\"https:\/\/news.sd.gov\/newsitem.aspx?id=28237\">Preliminary List of Conditions for Medical Cannabis Program<\/a>.<\/li><\/ul><p><strong>Flandreau Sioux Tribe Medical Marijuana Program<\/strong> &#8211; Sale of Medical marijuana can occur with a completed <a href=\"https:\/\/s3.documentcloud.org\/documents\/20973135\/fsst-medical-marijuana-form-final-002.pdf\" target=\"_blank\" rel=\"noopener\">application<\/a> and $50.00 fee.&nbsp;<\/p><p><strong><u>Medical Marijuana Use (SD Initialed Measure 26) &#8211; <em>goes into effect July 1, 2021<\/em><\/u><\/strong><\/p><p>Voters approved the ballot measure to allow medical marijuana use 69.2% to 30.8%.&nbsp; This will require the state to create a medical marijuana program for people who have debilitating medical condition as certified by a licensed physician.&nbsp; It also:<\/p><ul><li>Allows patients to possess a maximum of three ounces of marijuana<ul><li>Limits on other cannabis products would be set by the Department of Health.<\/li><\/ul><\/li><li>Allows patients registered to grow marijuana at home to have at least three plants.<\/li><li>Establishes requirements for the State Department of Health, including:<ul><li>Enact rules for implementing the medical marijuana program by October 29, 2021.<\/li><li>Issue registry identification cards to qualified patients by December 8, 2021.<\/li><\/ul><\/li><\/ul><p>There are other rules and restrictions involved in legalizing marijuana for both recreational and medical use.&nbsp; There are fines for violating the state and local regulations, taxes, and rules for licensing.&nbsp; Details on these areas are available at BallotPedia.<\/p><p><strong><u>Recreational Marijuana Use (SD Constitutional Amendment A) &#8211;<em> still working its way through courts<\/em><\/u><\/strong><\/p><p>This Amendment was approved 53.41% to 46.59%.&nbsp; What this does, and doesn\u2019t, do:<\/p><ul><li><strong>Individuals 21 years old and older may use marijuana recreationally. <\/strong>Possession, use and distribution of up to one ounce of marijuana would no longer be punishable under state law.<\/li><li>No more than eight-grams can be in concentrated form. <strong>Growing a personal supply <u>might<\/u> be allowed if:<\/strong><ul><li>A person lives in a jurisdiction that does not have a licensed retail store for marijuana.
